Contest Terms & Conditions
- All members must be 18 years of age or older, or have signature of approval from parent or legal guardian as indicated on the membership form.
- Officers, directors, employees, agents, and shareholders of BassTrac and their immediate families shall not be eligible for the boat giveaway(s).
- “Boat giveaway” shall be defined as BassTrac providing a randomly chosen member with a voucher to be used toward the purchase of a fully rigged boat from a participating boat manufacturer. The voucher has no cash value and must be used toward the purchase of a boat from a participating boat manufacturer. The prize cannot be assigned, transferred, exchanged or redeemed for cash.
- The boat giveaway winner acknowledges that BassTrac has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize described in these rules and regulations, including, but not limited to, its quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed by BassTrac, and the winner will accept the prize "as is." All federal, state and local taxes, fees and other expenses (including permitting, registration and insurance) not specified herein are winner's responsibility.
- No member shall have the right to change or alter the rules of the membership or boat giveaway(s).
- Any taxes required to be paid by a boat winner shall be the sole responsibility of the boat winner. BassTrac assumes no responsibility for any tax obligations or consequences resulting from the boat giveaway.
- Boat giveaway(s) and any agreement related to such giveaway shall be construed under the laws of the State of Tennessee. All promotional giveaways are void where prohibited by law.
- No person is eligible for boat giveaway(s) unless he or she has properly completed all membership forms and has submitted his or her annual membership fee and appropriate payment has been accepted. Once the membership form and proper payment have been received and verified, the member will be issued a confirmation of membership making the member eligible for the boat giveaway(s) and allowing the member to access BassTrac-member resources.
- There is a limit to one membership per person.
- Any violation of the rules that pertain to members will result in a member forfeiting his or her membership and eligibility for boat giveaway(s). BassTrac reserves the right to pursue any and all legal remedies against any such violation(s).
- The winner of each boat giveaway grants BassTrac the right to display BassTrac logos and design on the giveaway(s) boat rig for a minimum of one year from the date of boat delivery. If boat giveaway winner fails to comply with this provision, he or she agrees to pay BassTrac the market value of such advertising which in no case will be less than $15,000.00. By accepting the boat giveaway, the winner agrees to also pay for BassTrac’s legal fees required to fully enforce this provision.
- The boat giveaway(s) will be announced in no less than 30 days from the date that the required, qualified memberships have been confirmed. Memberships will be tracked electronically through BassTrac.com. With each 1,000 new, qualified memberships, BassTrac’s system will automatically select one member at random from all current members. BassTrac officials will then determine whether the member meets the boat giveaway requirements (e.g., at least 18 years old, not affiliated with BassTrac, etc.). Once a member is selected and qualified for the boat giveaway, he or she will be notified and the winner’s name will be posted on BassTrac.com.
- BassTrac reserves the right to decline or revoke any membership due to special circumstances or unforeseen hardship caused by a member at any time.
- Each user of BassTrac acknowledges and agrees that BassTrac is not liable for any information supplied by or through BassTrac or BassTrac.com. Each user assumes any and all risks associated with the use of such information and resources and holds BassTrac, its subsidiaries and affiliated businesses, and the officers, directors, contractors, employees and agents of each from any and all liability, damages, claims or causes of actions of any kind whatsoever (however named or described) for injuries, damages, or losses to person or property which may be sustained in connection with such usage or in connection with the boat giveaway, or the receipt, enjoyment or use of the prize.
- Each person who is a winner of the boat-giveaway shall grant permission to BassTrac, its subsidiaries and affiliated businesses to use his or her name, age, city, state, and photograph or other likeness for advertising and promotional purposes without additional compensation, except where otherwise provided by law. By entering this boat-giveaway sweepstakes, each member agrees to be bound by these Official Rules and the decisions of BassTrac and its agents, whose decisions regarding all aspects of the boat-giveaway shall be final.
- Each boat giveaway winner agrees to be available for an award ceremony and press-coverage event or events related to such giveaway.
- No member is eligible to win more than one boat per 12-month period.
- By using BassTrac resources, I agree to comply with and be bound by the rules and regulations set forth in these Official Rules.
- All membership credit card transactions will be conducted via www.Basstrac.com via a secured server. Any member paying by credit card must verify that he or she is authorized to use the credit card and that the card is not stolen or otherwise the property of someone other than the person using it. If it is determined that a member has paid for his or her membership with a credit card that he or she is not authorized to use, that member will be removed from the membership and will forfeit any opportunity to participate in the boat giveaway. In this circumstance, BassTrac will also consult law enforcement authorities to determine its obligation to report such unauthorized credit-card usage.
